‘Violation’ of Article 9, 14, 18, 23, 24, 25 and 38 of Constitution: LHC seeks report from police, admin till Feb 13

LAHORE: The Lahore High Court sought reports from the district administration and city police on the construction of multi-storey commercial buildings inside walled city in violation of a stay order, while FIRs against 136 developers have been lodged over doing illegal constructions.

The council earlier submitted that in order to enforce the fundamental rights especially Article 9, 14, 18, 23, 24, 25 and 38 of the Constitution of Pakistan, 1973, the up hazard and illegal constructions and commercial activities within the old city of Lahore controlled by the walled city authority and as well as the city district government was illegal.

Justice Syed Mansoor Ali Shah of directed the DCO and CCPO to submit their reports till February 13. Asif Ali Mirza, Abdul Razzak residents of walled city and Judicial Activism Panel chairman Muhammad Azhar Siddique moved these petitions. Azhar Siddique submitted the court had already stayed construction of 136 multi-storey buildings identified by Lahore Walled City Authority (LWCA) but so far it was not stopped.

Counsel earlier had submitted that the walled city authority was responsible to preserve Walled City, which was a national heritage, and it had lodged formal FIRs against 136 developers over doing illegal constructions.

The council said that the petitioner had also obtained license under section 30 of Act V, 1861 and the same was granted by the competent authority for conducting worship and taking out “tazia” Moharram Procession.
