Customs determined valuation ruling of liquid paste colorants‏

KARACHI: The Directorate General of Customs Valuation has determined the Customs value of   Liquid Paste Colorants of China, Taiwan and European origin vide Valuation Ruling No 724/2015 No. MISC/9/2014-II dated 31 March.

The Customs Department received numerous complaints against the liquid paste colorants regarding under invoicing during the import process. The Customs value of liquid paste colorants was determined under Section 25-A of the Customs Act 1969 vide Valuation Ruling No 724/2015 dated 31.3.2015.

For the determination of valuation ruling liquid paste colorants transaction value method which was laid down Vide sub Section (1) of Section 25 was found inapplicable due to non-availability of the required information as per law.

Identical and similar goods valuation methods were adopted to determine the Customs value under Section (5), (6) provided some reference, but for the purpose of issuance of valuation ruling the information was not enough and trustworthy. Market enquiry was also provided in the determination of and valuation ruling of liquid paste colorants under sub Section (7) of Section 25 of the Customs act 1969 was done. Consequently, the fall back method was envisaged under Section 25(9) of the Customs Act 1969 to determine the values of the items.

Five different meetings were also held with key stakeholders including their representatives of Federation of Pakistan Chamber Council and Industry along with Pakistan Council of Medical & Dental Association to discuss the current International values of Liquid paste colorants.

Therefore,  Directorate  General  Customs  has made an exercise to re-determine the Customs value of the liquid paste colorants under Section 25-A. The liquid paste colorants in black will come under Pakistan Customs Tariff Code 3206.4990 along with three proposed PCT Weboc 3206.4990.1000, 3206.4990.2000 and 3206.4990.3000 for three different origins. The black liquid paste colorants will be $2.50  from China, $2.75 from Taiwan and $3.15 from Europe per one kilogram.

The determination of  liquid paste colorants in other than black colour came under PCT Code 32.1700 along with proposed PCT for Weboc was 3204.1700.1000, 3204.1700.2000 and 3204.1700.3000 determined with the $3.75 from China, $4.15  from Taiwan and  $4.70 from Europe per one kilogram.

In case of consignments imported by air, the assessing officer shall take into account the differential between amount, between the air freight and sea freight at the time of applying the Customs value determined by this valuation ruling.
