Abu Dhabi Chamber organizes seminar on Landlord-Tenant Relationship

ABU DHABI: In cooperation with the Judicial Department in Abu Dhabi, the Abu Dhabi Chamber of Commerce and Industry organized a seminar on Landlord-Tenant Relationship in the Light of the Latest Amendment at the Chamber’s Tower in Abu Dhabi.

His Excellency Consultant Sultan Al-Neyadi, Abu Dhabi Commercial Court Judge, attended the seminar along with His Excellency Dr. Mubarak Al-Ameri, Board Member at the Abu Dhabi Chamber; His Excellency Mohammed Helal Al-Muhairi, Director General of the Abu Dhabi Chamber; and more than 250 representatives of companies and establishments operating in Abu Dhabi.

H.E. Al-Muhairi delivered a welcoming remarks at the beginning of the seminar in which he said that such a seminar comes within the awareness of the Abu Dhabi Chamber to support and help its members of companies and businessmen and to view what they face from challenges, identify them and find proper solutions in order to activate their role in the comprehensive and sustainable development process in the Emirate of Abu Dhabi.

The Director General noted that the Board of Directors of the Abu Dhabi Chamber had formed many committees to solve all the issues in the different economic sectors in a way that serves the best interest of the members of the Chamber. Pursuant to the belief of the Abu Dhabi Chamber in the effective role of property sectors in the economic development process of the Emirate of Abu Dhabi, the BoD has formed a committee from the board members of the Chamber to study the problems and challenges that face property investment and find proper solutions for them and report them to the BoD and then to the related authorities in the emirate.

H.E. Al-Neyadi also spoke during the seminar, pointing to the role of the Property Dispute Resolution Committee in implementing the Decision of the Executive Council in stopping the extension of leasing contract and the 5% annual increase in the leasing price since 10th November 2013. He added that according to Article No.149 of the constitution and to the legislative mandate in Article No.26 of the Federal Civil Procedures, the local legislator in Abu Dhabi released Law No.20 of 2006 concerning Tenancy of Places and Controlling the Relation between the Landlord and the Tenant, and its amending laws No.6 of 2009 and No.4 of 2010.

According to such amendments, these committees were transferred from the General Secretariat of the Executive Council to the Judicial Department.

Al-Neyadi added that in order to keep balance between the landlords and the tenants in Abu Dhabi, there should be a governmental interference to specify a ceiling for leasing prices according to the area in which the premises are built.

For his part, Dr. Anas Al-Habashneh, Commercial Law Professor, spoke of the effects of releasing the relation between the landlord and tenant in the Emirate of Abu Dhabi and the proposed solution. In his speech, he referred to Law No.20 of 2006 concerning Tenancy of Places and Controlling the Landlord-Tenant Relation in Abu Dhabi.
