The U.S. Court of International Trade denied a Chinese garlic importer’s challenge to a hefty bond it was required to post on shipments to the U.S., finding that the company’s failure to verify the source of the garlic subjected it to steep anti-dumping duties.
U.S. Customs and Border Protection was within its authority to require Kwo Lee Inc. to post bond to cover anti-dumping duties of 376 percent — the general rate imposed on Chinese garlic exporters for more than 20 years.
