The court also directed Chairman Sargodha Improvement Trust, secretary housing and others to hand over possession of plots to allottees within six months.

Justice Muhammad Farrukh Irfan Khan passed the orders while deciding petitions filed by Muhammad Amir Ameen and other allottees.

The court, in its nine-page detailed judgement released Saturday, restrained respondent officials from receiving any further amount in the name of development charges and directed to hand over possession to allottees in six months after completing all remaining development work.

The court also noted that the Punjab Ombudsman had already announced decision against the Sargodha Improvement Trust wherein it was held that despite receiving funds the trust had failed to complete development works in Model Town Sargodha in 20 years.

Such works were completed in a period of two to five years in private sector housing schemes, while the DCO Sargodha as chairman trust and his team failed to fulfil their responsibilities.

The court observed that the allottees could not be punished for maladministration and perusal of society record revealed that the Trust did not show seriousness since inception.
