DC Kaukab decides case of foreign fabric

ISLAMABAD: Deputy Collector Customs ( Adjudication) ,Islamabad  Dr Kaukab Farooq has passed  the ORDER-IN-ORIGINAL No 204 of 2014 in seizure case of  foreign- origin ladies suiting fabric printed and plain( Viscose Rayon ,Mercerized Cotton) and marble powder along with an offending Hino truck .

In her order, she said seized cloth in the instant case was illegally imported but the customs appraised value of seized cloth is Rs 18,44,000 and there are 14 owners of seized cloth. Therefore the share of each owner is less than the statutory limit of Rs 1,50,000 so that the subject  cloth does not fall under the category of “Smuggled Goods “in the terms of section 2 (S)(ii)of the custom Act,1969.

Keeping in the view the willingness of the respondents to pay the duty and taxes leviable thereon and no applicability of statutory limit of Rs 1,50,000 a lenient view is taken and the owners of the seized cloth are given option to redeem the same against duty and taxes plus a redemption fine of 30 percent of the appraised value of the seized cloth in terms of section 181 of the custom Act ,1999 in the lieu of confiscation .

As far the remaining seized goods marble powder are concerned, the same is released unconditionally being non-offending goods as per seizure report. She also ordered for release of the seized Hino Truck against a penalty of Rs 50,000.
