ISLAMABAD: Ehtesham-ul-Hq, a Customs Inspector, has been given major penalty of ‘reduction to a lower stage in time scale – three stages lower’ over misconduct.
Thes disciplinary proceedings, under Government Servants (Efficiency & Discipline) Rules, 1973, were initiated against Mr. Ehtesham-ul-Hq, posted at Model Customs Collectorate of Preventive, Lahore vide Charge Sheet No.17(11)Cus-III/2014 dated 15.10.2014.
Syed Jawad Ali Shah, Deputy Collector, MCC (Appraisement), Lahore was appointed as Inquiry Officer to conduct inquiry on account of unauthorised absence from duty since 02.04.2014 of the accused officer constituting “misconduct”. According to the Inquiry Officer’s report charges levelled against the accused officer have been established. A show-cause notice was issued to the accused officer and he was also called for personal hearing by the Authorised officer.
After considering the charges framed in the charge sheet, inquiry report and other available record, the accused officer has been found guilty of “misconduct” under rules 3(b) of the Government Servants (Efficiency and Discipline) Rules, 1973.
The Member (Admn) FBR being Authority in this case, after having considered all aspects of the case and the recommendations of the Authorised Officer imposed the major penalty of “reduction to a lower stage in time scale – three stages lower” upon Ehtesham-ul-Haq under rule 4(1)(b)(i) of the Govt Servants (Efficiency & Discipline) Rules, 1973.
The period of his unauthorised absence from duty for 173 days from 05.04.2014 to 24.09.2014 will be treated as EOL without pay & allowances. On conclusion of the proceedings, he is deemed as reinstated and his suspension period from 25.07.2014 onwards is treated as leave of kind due and admissible under the rules.
However the officer has the right of appeal as admissible in the Civil Servants (Appeal) Rules, 1977.
