SHC seeks Customs reply to release consignment of engine parts

KARACHI: The Sindh High Court (SHC) has summoned comments from Pakistan Customs authorities on a petition seeking release of the consignment of engine parts.

A division bench of the SHC adjourned the hearing when the counsel for the customs authorities sought time to file comments. M/s Chief Auto Centre (Private) Limited submitted that it had imported 10.466 metric ton of Japanese origin liners and piston ring sets for diesel engines of assorted brands classifiable under HS Code 8409.9999. Those engine parts are used in excavators, fork lifters, and bulldozers.

Advocate Kailash, the counsel for the petitioner, stated that the importer through its clearing agent filed goods declaration for the assessment of the goods. Upon payment of duty and taxes the consignment was declared out-of-charge.

However, when the petitioner’s carrier approached the authorities for release of the consignment, it was told that the consignment has been detained for re-assessment of duty and taxes, as the engine parts imported by the petitioner for the vehicle are classifiable under HS Code 4809.9910.

The counsel argued that the HS code under which the customs officials are assessing the duty and taxes is not applicable to his client’s consignment, as goods were essentially for diesel engine. The petitioner requested the court to order the authorities to release the goods.
