SC rejects drug peddler’s petition against conviction

ISLAMABAD: Supreme Court of Pakistan dismissed the petition of accused Khan Haider who was awarded life imprisonment along with fine amounting Rs 100,000 in a narcotics case registered by the Anti-Narcotics Force (ANF)

According to the details, on 28 January 2006, the Karachi ANF received information through its source that a narcotics den is being operated under the patronage of Khan Haider at Muslimabad Colony, Landhi, Karachi. After confirmation of the information, the ANF team raided the place and apprehended the accused Khan Haider red handed, recovering 500 gram heroin from his personal possession.

Detailed search of place led to recovery of 23.3 Kg charas and 5 Kg opium, which were placed in three nylon bags. Resultantly, ANF registered FIR No 05/2006 under 9-C of CNSA at PS-II ANF Karachi.

During the course of trial, ANF stood firm on all particulars of the case and testimony could not be shaken despite lengthy cross-examinations court.

Finally, CNS Court Karachi vide its judgment dated May 28, 2009, convicted the accused Khan Haider with life imprisonment along with fine amounting Rs 1,00,000. Moreover, in case of default he was to undergo further 6 months as rigorous imprisonment.

Later, on March 30, 2013, the accused filed an appeal before Sindh High Court (SHC), in which CNS Court decision was upheld and case was dismissed. Consequently, the accused filed petition before Supreme Court of Pakistan against the judgment of SHC.

However, the apex court dismissed his petition vide its judgment dated November 20, 2015 and upheld the judgment of conviction passed by all courts, thus awarding the decision in favour of ANF. It took nearly 10 years of rigorous prosecution by ANF that the accused could be finally brought to justice.
