FAISALABAD: Customs Adjudication Deputy Collector Asma Hameed issued ONO for outright confiscation of 392 kgs of foreign origin sofa cloth in different colors by deciding the case in favour of ASO Sargodha.
As per details, Anti smuggling organization Sargodha had seized 392 kgs of smuggled sofa cloth from a donkey cart during cursory search at a naka near satellite town chowk Sargoda. The donkey cart owner was identified as Jamil Akhtar. ASO team asked Jamil Akhtar to produce legal documents regarding this but he only showed bilty number issued by 786 super star goods forwarding agency.
After investigation, ASO Sargodha has identified the owner of the smuggled goods name as Meer Alam Khan from Lahore and registered a case against him. The case was forwarded to Customs Adjudication.
Advocate Ghulam Murtaza appeared on behalf of the respondent. He stated that the seized goods were purchased by the accused against sales tax invoice from the supplier who legally imported these goods.
Nazar Hussain inspector appeared and reiterated the charged leveled against the respondent. The respondent has failed to establish a genuine link between import and himself with reference to his transaction.
As the sales tax invoice presented by the respondent is not reflected in the sales tax returns of the relevant tax period of their supply. The respondent has further not been able to bring any other documentary proof to their transaction.
Therefor, D.C Asma Hameed ordered for outright confiscation of the seized sofa cloth in favour of Federal Government under section 156(1)89(i) of the customs act 1969
