The show cause notice asked the appellant that “why Rs 9,313,925 should not be recovered from appellant in the head of FED?”

The appellant had prayed the court to declare the show cause notice illegal and without any lawful grounds. It further pleaded the court restrain FBR from recovery and from recovering default surcharge and other additional taxes out of FED tax.
