Customs Adjudication-I serves notice on M/s Zaghum Enterprises for evading taxes

KARACHI: Customs Adjudication-I Collector Abdul Basit Chaudhary has issued a show-cause notice to M/s Zaghum Enterprises on allegedly evading around Rs 200,000 by availing undue benefits of SRO 659(I)/2007 on import of uncoated polyester film.

The notice stated that during the audit of import clearances made under different concessionary SROs, it has been found that M/s Zaghum Enterprises imported consignment of uncoated polyester film and availed benefit of SRO 659(I)/2007 dated August 30, 2007, whereas the goods are correctly classifiable under PCT Heading 3920.6200 on which concessionary rate of duty/taxes is not available.

The notice further stated that in identical imports made by the other importers, assessing group has categorically rejected the declared classification of goods under PCT heading 3920.6310 as well as claim of concessionary rate of customs duty at 5 percent under SRO 659(I)/2007. On the ground that the imported item (uncoated polyester film) is correctly classifiable under PCT 3920.6200 chargeable to customs duty at the rate of 20 percent, sales tax at 17 percent and withholding tax at 6 percent.

The show cause notice added that “It is, therefore, clear that M/s. Zaghum Enterprises, Karachi with active involvement of their clearing agent M/s Haji Muhammad Enterprises willfully and knowingly mis-declared the imported goods under PCT heading 3920.6310 in order to avail the concessionary rates.

Hence, the collector has issued a show-cause notice to the importer asking for justification as to why the duties/taxes were short paid.
