KARACHI: Sindh High Court issued notices to Chairman FBR, DG Customs Valuation, Collector of Customs and Deputy Attorney General directing them to file their comments on a application seeking release order of consignment related to the duties and taxes matter.
While hearing the application, the SHC division bench headed by Chief Justice Sajjad Ali Shah directed the respondents to make sure the submission of their comments in the next hearing.

Earlier M/S Ghalib International (Pvt) Ltd stated that petitioner imported a used industrial plant machine having net weight of 15955 kilograms from Italy with intent to install the plant in the country for production of stainless steel pipes, tubes, coils sheets and etc. Entire plant has been purchased for a sale consideration of Euro 115,000.00 which becomes about Rs 13,353,374.
The Importer said that plant and it’s parts fall accordingly have applied and there is not dispute with respect to rate and duty but respondents had asked to assess to consignment in accordance with the valuation ruling no 571/2013 dated 24/03/2013 which provides rate/value of the plant in question at US $165.00/KG.
The counsel added that plant was purchased through competent court of law of Italy as such there is no question of any doubt in the rate/price /value.
It was mentioned the valuation ruling no 571 /2013 dated 24/07/2013 had also expired after 90 days, it’s expiring is not only unfair but it is also infringement of the fundamental rights. The Importer added that due to delay in release of consignment petitioner will face financial losses. The court was requested to order the release consignment.
