SHC directs customs to release consignment of cold roll sheets

KARACHI: The Sindh High Court directed the customs authorities to release the consignment of cold roll sheets of the petitioner after payment of duties and taxes, as leviable and upon securing Provisional Anti-Dumping Duty by the way of pay order with the Nazir of the SHC.

A two-member bench headed by Chief Justice Sajjad Ali Shah also directed to the respondeds to decide the issue with 30 days.

During the hearing, counsel of the petitioner  ( M/s Al-Karam Mercantile Corp ) stated that he challenged the Provisional Anti Dumping Duty, imposed on their consignment of the Cold Roll Sheets before the National Tariff Commission by availing the remedies provided in the departmental hierarchy in accordance with law, however, presently grievance of the petitioner is only to the extant of the release of the consignment and he is ready and willing to secure the amount of Provisional Anti Dumping Duty by the way of pay orders with the Nazir of the court.

Earlier counsel stated in the petition that Chairman National Tariff Commission issued notice to the petitioner dated 13th January 2016 and enforcement for collection by collector of customs the import consignment of cold rolled steel from China, which is not otherwise payable under the law as the petitioner has entered into import contract and established letter of credit prior to the publication of impugned notice.
