Provide petition’s copy seeking exemption certificate to FBR, SHC directs

KARACHI: The Sindh High Court (SHC) on Wednesday directed the M/S Wings Security Pvt Ltd to supply the copy of the petition to the respondents in a case pertaining to the income tax exemption certificate.

A single judge comprising Justice Munib Akhter heard an application filed by the M/S Wings Security Pvt Ltd which sited Ministry of Finance secretary, FBR chairman, Karachi RTO-II chief commissioner, Karachi RTO Income Tax zone-I commissioner as the respondents.

Earlier, the counsel for the petitioner stated that petitioner is running a security agency and hires retired army personals as well as private person and having license obtained from federal government and regularly paying renewal fee within stipulated time.

The petitioner filed an application to the respondent for granting exemption under Section 153 (4) of the Income Tax Ordinance, 2001, which was granted and respondent issued exemption certificate which was extended time to time.

However petitioner filed an application for issuance of exemption certificate from the period January 1 2016 to June 30, 2016, but the petitioner’s request was rejected by authority concerned after informing it that it has failed to fulfill the conditions laid down in the Ministry of Law and Justice and Human Rights.

The counsel pleaded the SHC to direct the respondents to issue exemption certificate to the petitioner without delaying anymore.
