M/S Nizami withdraws application seeking duty exemption against customs

KARACHI: The Sindh High Court (SHC) on Friday dismissed an application filed by M/S Nizami (Pvt) Ltd seeking exemption of customs duty on import of animal feed after the petition was withdrawn.

The SHC division bench headed by Chief Justice Sajjad Ali Shah heard the application.

“The grievance of the petitioner stands redressed; therefore, he doesn’t press the instant petition” the learned counsel stated during hearing.

Earlier, the petitioner’s counsel stated that it is a manufacturer of prepared animals feeds and has entered into a contract with M/S R01-55 Boulevard Jules Verger BP1080-35803 Codex Dinard for supply of “30 metric tonne of dicalcium phosphate feed grade power CN 18 percent bag 50 kilogram at a declared invoice value of $111,300,00. According to the petitioner, after fulfilling all the all requirements, shipment was effected from the port of loading to port discharge at Karachi.

According to the petitioner, customs authorities denied the benefit of exemption of customs duty under serial number 214 of Table-II of the SRO 659 (1)2007 on June 30, 2007 without any reason. Despite the fact that petitioner comply all the conditions of the above notification/SRO, the authorities concerned still made this act against it.
