ISLAMABAD: Mazhar Wasim, a Pakistan Customs Service officer of BS-18, has been dismissed over unauthorised absence from duty.
As per details, the disciplinary proceedings were initiated against the officer under Government Servants (Efficiency & Discipline) Rules, 1973, on account of unauthorized absence from duty with effect from June 27, 2014 to July 28, 2015 constituting ‘inefficiency’ and ‘misconduct’ in terms of Rule 3(a)&(b) ibid.
The authorised officer/Member (Admn), keeping in view the obviousness of the charges against the accused officer and material available on the case record, proceeded against the officer, under Rule 5(1)(iii) Government Servants (Efficiency & Discipline) Rules, 1973, by dispensing with the option of holding of inquiry under Rules 5(1)(ii) & 6 ibid and directly issuing show-cause notice for imposition of one or more penalties including a major penalty of “removal from service”.
The officer joined duty in FBR (HQs) July 29, 2015, however, he again disappeared from duty on September 01, 2015 and left the country for the UK on September 04, 2015 without obtaining prior permission/NOC from FBR, thereby constituting ‘inefficiency’ and ‘misconduct’.
The authorized officer/Member (Admn) and the Authority/Secretary Revenue Division also granted hearing opportunities to the accused officer, however, he did not appear in hearings.
The authority, after having gone through the case record and reply to the show-cause notice, found Mazhar Wasim guilty of the charge of ‘misconduct’ as levelled against him and imposed a major penalty of “removal from service” upon him, under Rule 4(1)(b)(iii) of the Government Servants (Efficiency & Discipline) Rules, 1973.
The period from June 27, 2014 to July 28, 2015 and from September 04, 2015 to April 05, 2016 during which Mazhar Wasim remained absent from duty will be treated as extraordinary leave without pay.
However, the dismissed officer will have right of appeal to the Appellate Authority as provided under the Civil Servants (Appeals) Rules, 1977.
