Earlier, the petitioner’s counsel stated that petitioner’s company has received a letter on 18th January 2016, wherein it has been alleged by M/s SCG  that the petitioner’s company delivery vans and motorcycles, which are plying in the territorial jurisdiction of the Cantonment Board Clifton, are also subject to professional tax.

Therefore, they sought registration numbers of vehicles so that professional tax can be imposed on each vehicle as per rate specified according with law. Citing secretary defence military lands and cantonments department, secretary inter-provisional coordination division, secretary excise and taxation, executive officer of Cantonments Board Clifton and M/s SCG as respondents, the counsel argued that the act of respondents is unlawful and without jurisdiction.
