SHC postpones hearing of petition filed against suspension of sales tax registration

KARACHI: The Sindh High Court (SHC) adjourned the hearing of an application filed by Jamal Abdul Qadir against suspension of his sales tax registration.

Earlier, a division bench of the SHC comprising Justice Munib Akhter and Justice Abdul Malik Gaddi had suspended the order of of the tax authorities.

Earlier, the petitioner’s counsel stated that petitioner is an importer and exporter with the name of style and is holding sales tax registration in the name of M/s AJ Enterprise since August 11, 2015 and filing his monthly sales tax returns in according with the law.

The counsel said that sales tax registration of the petitioner was suspended through an order issued on January 27, 2016 by the Commissioner-IR Zone -1, Regional Tax Office. In the suspension order, it was alleged that the registered person is not a genuine business concern and is involved in evasion of sales tax.

The petitioner said that he replied and explained the situation but the respondent did not agree to withdraw the suspension order, therefore, the business has come to a halt due to blockade of finances.

According to the petitioner, he is unable to fulfill his commitments in the market and apprehends that he may suffer heavy demurrage if the situation continues.

Citing Secretary Ministry of Finance, Chairman FBR, the Commissioner -IR Zone -1, Regional Tax Office as respondents, the petitioner prayed to the court to set aside the impugned order and restore his sales tax registration.
