Customs directed to release consignment of M/S A-One on duty/taxes’ payment

KARACHI: The Sindh High Court (SHC) directed the customs authorities to release the consignment of orange brand industrial sewing machine’s needles etc upon payment of all duties and taxes.

The SHC division bench, headed by Chief Justice Sajjad Ali Shah, was hearing the petition filed by M/S A-One Sewing Machine. The court directed the customs authorities to release the consignment after obtaining differential amount between the declared and assessed value by way of pay order. It also directed to respondents to ensure the adjudication within 30 days.

Earlier, the petitioner’s counsel stated that petitioner had imported a consignment of orange brand industrial sewing machine needles etc and filed goods declaration and deposited upfront duty and taxes of Rs 1,134,419 on the basis of declared value.

According to the petitioner, the respondents issued a show cause notice to it stating that after the examination of data fair value of needles was ascertained to be $44.08 per kilogram instead of $1.98/kg.

According to the customs, the petitioner deliberately and wilfully mis-declared value and evade duty and taxes amounting to Rs. 7.5 million causing loss to government revenue. However, the counsel of the petitioner argued that petitioner had fulfilled all the conditions and liabilities. It asks the SHC to set aside impugned show cause notice.
