SHC seek comments from tax authorities on plea filed by Mrs Ismat Mahdi advocate

KARACHI: The Sindh High Court (SHC) has sought comments from the FBR chairman, deputy attorney general and others on a petition filed by a senior lawyer of the SHC, Mrs Ismat Mahdi advocate against notice of the FBR asking her to submit details of properties, banks accounts and all kinds of expenses during the period from July 1, 2013 to June 30, 2014.

A two-member bench comprising justice Munib Akhter and Justice Abdul Malik Gaddi heard the petition.

During the hearing counsel for the petitioner stated that the issues raised in the petition are already pending before the court in other matters and interim relief has been granted. After the hearing,  the court issued notices to the respondents directing them to file their comments on 24th May 2016. It also suspended the impugned notice of the FBR till the next hearing.

Earlier, Federal Board of Revenue (FBR) had issued notice to senior lawyer of the Sindh High Court (SHC) Mrs Ismat Mahdi advocate asking her to submit the details of properties, banks accounts and all kinds of expenses of the period from 1st July 2013 to 30th June 2014.

Ismat Mahdi was informed that FBR, Islamabad has selected her case for an audit therefore she was requested to provide the details of account. She was also directed to provide the details of bank statement, trading account, /profit & loss account, cash book, bank book, general ledger, details of sales, purchases with bills ,vouchers and cash memos. In the notice, she was directed to furnish the copies of all bank statements along with personal bank statement maintained by her.

The notice summoned the details and copies of, telephone, mobile phones, electricity, gas, and fuel purchase for which are in the shops/ sales outlet/ offices. She was also directed to produce the copies of the sales tax returns along with copy of audit report, documents of ownership regarding residential house declared and copies of the all relevant documents.
