SHC seeks reply from officials on plea by Umar Jawad against suspension of sales tax registration

KARACHI: The Sindh High Court (SHC) has sought comments from tax authorities and deputy attorney general on a constitutional petition filed by M Umar Jawad, seeking restoration of his sales tax registration which was suspended by the Commissioner RTO- II Zone-III.

A two-member bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, heard the petition.

Earlier, the petitioner’s counsel stated that the petitioner is engaged in manufacturing and importing of tanning and dressing of leather products and is paying all leviable taxes regularly. However,  the commissioner RTO- II zone- III issued him a show cause notice under section 21  (2) of the Sales Tax Act,1990 and the petitioner filed a proper reply in this regard.

According to the petitioner, however, respondent suspended the sales tax registration of the petitioner. He filed an appeal before the Customs Appellate Tribunal which is pending due to non-availibility of the hairman of said tribunal. Counsel argued that due to which petitioner is unable to carry on business activity.

Citing chairman FBR, Appellate Tribunal Inland Revenue (ATIR), Commissioner RTO-II as respondents petitioner pleaded the SHC may set aside impugned notice and restore his sales tax registration.
