SHC seek remarks from M/s Khuda Raham on plea filed by Collector Hyderabad

KARACHI: The Sindh High Court (SHC) has sought comments from M/s Khuda Raham on an appeal filed by the Collector Customs Collectorate Hyderabad challenging the verdict of Customs Appellate Tribunal that released alleged smuggled 60,000 liters of HSD. The SHC bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, heard the appeal.

During the hearing, the counsel for the applicant requested for urgent hearing which was accepted by the court. It issued notice to M/s Khuda Raham to appear and file their comments in the next hearing.

Earlier, the counsel for the applicant stated that on a credible information, an oil tanker, which was carrying approximately 60,000 liters HSD, was intercepted on Jan 24,2016 but tanker driver namely Mohammed Ismail failed to give satisfactory reply.

Therefore, oil tanker was taken under custody and was brought to the customs house Hyderabad. During the investigation officials of the customs authorities issued a show cause notice to M/s Khuda Raham owner of the said tanker, however, it filed an appeal before the Customs Appellate Tribunal which was allowed the said oil tanker was released by the Tribunal.

The appellant’s counsel said that tribunal has completely ignored the facts and warrant of law and passed the order without lawful authority. Citing M/s Khuda Raham and  Customs Appellate Tribunal bench-III as the respondents, the applicant pleaded the SHC to set aside impugned verdict of the tribunal.
