SHC adjourns hearing of petition filed by M/s i2 Pakistan against selection of audit

KARACHI: The Sindh High Court (SHC) has adjourned the hearing of a petition filed by M/S i2 Pakistan (Private) Limited against selection of its audit for the period from July 2012 to June 2014.

The hearing was fixed before a two-member bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, but it could not take up due to shortage of time.

Earlier, the petitioner’s counsel stated in it’s petition that petitioner is engaged in the business of importing and distributing mobile phones, contributing huge amount of sales tax in the government exchequer.

According to the petitioner, the additional commissioner Inland Revenue, Audit Range Zone, III has issued a intimation notice on 9th December 2014 and intimated that commissioner Inland Revenue, Zone – III Regional Tax Office, III selected M/s i2 Pakistan (Pvt) for the audit for the period from July 2012 to June 2014.

“The petitioner pays sales tax and never defaulted in paying sales tax. The respondents have no powers to select a taxpayer for an audit and this power vest solely with the chairman FBR, who is required to conduct a random and parametric ballot to select taxpayer for an audit. But said respondents are sending notices for audit without lawful authority and of no legal effects,” the counsel argued.

The petitioner prayed to the SHC to set aside the impugned notices and restrain the respondents from taking any action against it.
