IHC directs ATIR to decide important tax matters within 60 days

ISLAMABAD: The Islamabad High Court (IHC) has directed the Appellate Tribunal Inland Revenue (ATIR) to decide some important tax matters within 60 days.

In this regard, M/S Wateen Telecom Limited and Pakistan Mobile Telecommunication Limited’s cases remained important on which Justice Aamer Farooq ordered the appellate tribunal to decide their stay applications within 60 days.

M/s Wateen Telecom Limited had submitted a plea and asked the court to restrict the Large Taxpayers Unit, Islamabad (LTU) from recovering Rs 1,878,191 from it. The department had issued the demand for the tax year 2009 under the head of income tax under provisions of Income Tax Ordinance, 2001.

Similarly, Pakistan Mobile Telecommunication Limited had also challenged Large Taxpayers’ Unit’s order to recover outstanding tax amount of 98,869,352 along with default surcharge of Rs 30,526,036.

The IHC not only restricted the FBR from realizing the recovery but also issued directions to the Appellate Tribunal Inland Revenue (ATIR) to perform its duty efficiently and decide the stay application within 60 days. The court also directed the tribunal to submit a report to the IHC administration on compliance of the court orders.
