SHC rejects bail petition of suspect involved in drug smuggling

KARACHI: The Sindh High Court (SHC) has rejected the bail application of two suspect, Abdul Khair and Muhammad Akram, who were arrested in a drug smuggling case. Earlier, the Special Narcotics Court – II (CNS) Karachi had also rejected their bail application in December last year.

A single bench of the SHC comprising Justice Syed Muhammad Farooq Shah heard the application and observed in the judgment “on the assessment of the available record, the accused/ applicants are prima facie connected with the commission of offence and thus are not entitled to the concession of bail. Consequently, the bail application is dismissed. However, the trial court is directed to expedite the trail and conclude it within a period of two months”.

During the arguments, the counsel for the applicants submitted that applicants were driver and bus conductor and they had no knowledge about that therefore they should be granted bails. However, learned prosecutor opposed the bails pleas. After hearing the final arguments, the court rejected the “after arrest bail” application.

According to the prosecution, on an credible information on September 30,2015, a passenger bus was intercepted at Mochko Check Post and search was conducted. During the search, polypropylene bag containing 9 lumps/slabs of charas was found from behind the driving seat.

The bus driver Abdul Khair and conductor Muhammad Akram were taken into custody and FIR also was registered. The crime no ASO-146/2015 was registered at Police Station Customs, Karachi under section 6/9-C of Control of Norcotics Substance Act,1997.
