LHC seeks remarks from govt over tax on import, exports

LAHORE: Lahore High Court (LHC) sought comments from federal government on petition filed against tax imposed on imports and exports through Punjab Infrastructure Development Cess.

Justice Shahid Karim heard the case filed by Nishat Chunian Mills Ltd. During hearing of the case counsel for petitioner Mohsin Virk advocate said that this tax was imposed by Punjab government and Punjab Revenue Authority collects this tax at the ratio of .9 percent from all industries of the province which is illegal.  He argued that only federal government have the authority to impose any tax and levy of tax by provincial government is totally illegal.

He said that imposition of this tax is violation of section 142 and 151 of Infrastructure Development Cess Act. After hearing the arguments Justice Shahid Karim issued notice to federal government and provincial government to submit their reply during next date of hearing. The court also issued notice to attorney general to present himself during next date of hearing to assist the court.
