Adjudication DC Asma orders to impound truck, animal hides

FAISALABAD: Collectorate of Customs Adjudication Deputy Collector Asma Hameed has ordered to confiscate the foreign origin animal hides along with carrier, truck.

As per details, the deputy collector issued Order-in-Original (ONO) in favour of the Faisalabad Customs Intelligence and Investigation while deciding the case.

As per details, in pursuance of information, the customs staff intercepted a truck bearing Registration No Z-8133 near Dawood Khel Road Mianwali and found foreign origin hides of animals.

The driver of the truck named Mohammed Sabir was asked to produce any documentary evidence showing legal import of the hides. He produced a copy of GD vide Machine No. 2164. But no other mandatory import documents such as commercial invoice, packing list etc were produced.

The weight of subject foreign goods loaded on the truck was also suspicious; therefore, the truck moved towards Pupo Khan Computerised Weigh Bridge, Kalabagh Road for measuring weight, which was 38710 kilogram. The weight was also not according to the documents.

Therefore, the truck along with loaded items was impounded under the customs laws and the case was sent to the Customs Adjudication for further proceedings.

However, the respondent showed his willingness to pay leviable duty/taxes on the seized foreign origin animals’ hides.

The deputy collector after the hearing the arguments issued ONO stating, “Hence it is concluded that seized goods had been brought into the country through an unauthorised route without payment of leviable duty and taxes”.

She ordered to seize the goods under Section 156 (1), 90 of the Custom Act, 1969 read with SRO-499 (1) and also ordered to impound the truck under Section 157 (2) of the Custom Act, 1969.

The deputy collector gave an option to redeem the vehicle on payment of Rs 100,000 under Section 181 of the Custom Act.
