Rs 25.6m tax evasion: Z A Pharma Enterprises case hearing on Dec 10

KARACHI: A hearing memo for the final hearing of over Rs 25.6 million has been affixed on the notice board of MCC Appraisement-East.

The memo affixed along with the show cause notice issued by the Collectorate of Customs (Adjudication II) had sent the original copy of the notice as well as the hearing memo to proprietor/partners of M/S Z A Pharma Enterprises with the request that the same be affixed on the Notice Board of MCC of Appraisement-East, Custom House Karachi under Section 215 of the Customs Act, 1969.

According to details, M/S Z.A. Pharma Enterprises evaded payment of Customs Duty, Sales tax and Income Tax of Rs 25.6 million in the import consignment of Disodine Dihydrogen Phosphate. The company paid a total duty and taxes of Rs 14.94 million against a total duty and taxes recoverable of Rs 25.6 million through claiming inadmissible benefits of SRO 567(1)/2006 dated June 5, 2006; SRO 551(1)/2008 dated June 11, 2008 and reduced rate of Income Tax by claiming the status of “industrial undertaking”.

Z A Pharma Enterprises evaded Rs o.59 million in Customs Duty; Rs 19.3 million in Sales Tax; Rs 4.08 million in Additional Sales Tax and Rs 1.62 million in Income Tax. An earlier show cause notice dated September 5, 2014 dispatched to the company at Villa No. 1B, Defence Garden, Sugar Mill Road, Joharabad, District Khushab was received back undelivered with remarks from the courier stating “Company Shift”. The hearing was fixed for September 16, 2014.

The final hearing of the case is now fixed for December 10 at 12 noon at the Chamber of Collector Customs, Collectorate of Customs (Adjudication II), 6th Floor, Custom House, Karachi.

Besides asking the MCC Appraisement-East to affix the Hearing Memo at its notice board the Collectorate of Adjudication II has also requested Appraisement-East to depute an officer conversant with the case at the hearing.
