The counsel added that the field formation collected excessive tax from taxpayers during last three years. The petitioners approached the commissioner concerned many times for refunds but no any action was taken in this regard.

At the end, the appellants decided to approach Federal Tax Ombudsman (FTO) to interfere in this case and direct the Lahore RTO to clear the pending refund claims as early as possible, the counsel argued, adding that the RTO should clear the refunds at the end of fiscal year but it did not do the same.

On the other side, counsel for RTO argued that the appellants did not submit all the record on the basis the company was claiming refunds. If appellants provide accurate record to RTO, the case will be settled after assessment.

He further said that the RTO collected accurate amount of tax from the appellants, adding that they could contact office with record to eliminate the doubts.

After hearing the arguments from both sides, Advisor of FTO Muneer Qureshi adjourned the case until next date for further hearing and directed the parties to appear on the said date.
