SHC adjourns case against Valuation Ruling No 881

KARACHI: The Sindh High Court (SHC) has adjourned the hearing of an urgent application of a constitutional petition filed by M/s Rafiq Commercial Company against fixation of the valuations from $0.20 to $ 4 and 6.80 per kg for curtain blind fabrics.

The case was fixed before a two-member bench, comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M Sheikh; however, due to shortage of time, the court adjourned the hearing for a date, which would be announced according to the roaster.

Earlier, counsel for the petitioner stated that petitioner has imported “curtain blind fabrics” rolls under PCT Heading 5903.90000 having a quantity of 36,800 meter and PCT Heading 5516.9400 having quantity of 18,000 meter at the rate of $0.20 per meter. However, value was changed from $0.20 to $4 and 6.80 per kg.

According to the petitioner, the federal government has imposed fixed 5 percent unlawful and the same is usually fixed on luxury and finished item. It said that consignments of the petitioner are lying at the port un-cleared since June 2016 increasing charges, which is otherwise not payable by the petitioner and demurrage charges is increasing day by day due to reason the petitioner is suffering from the supplying of the goods to market.

Citing Revenue Division secretary, Customs Valuation director, Customs Appraisement collector and others as respondents, the petitioner pleaded the SHC may declare that the  valuation Ruling No 881 dated June 29,2016 issued by the respondents as clear violation of law and court may direct the respondents to release the consignments of the petitioner according to law.
