SHC issues notice to tax authorities on petition filed by M/s Mansoor Industry

KARACHI: The Sindh High Court (SHC) issued notices to tax authorities on a constitutional petition filed by M/s Mansoor Industry seeking court order for allowing its consignment “prime grade hot-dipped zinc coated steel coils ” from port area to bonded warehouse.

While the hearing of the petition, a two-member bench, comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M Sheikh also directed the respondents to submit their respective comments for August 8, 2016.

Earlier, petitioner’s counsel stated that it has imported a consignment of  “prime grade hot -dipped zinc coated steel coils” which has been arrived into Pakistan as on 19/06/2016 vide IGM no KAPW 157/2016 dated 19/06/2016 and petitioner filed goods declaration bearing no PAPW-IB-2470 dated 11/07/2016 , however, officials of the respondents have been delaying into bonding of the consignment since more than one month, the consignment has been laying wherein port area under heavy port demurrage and container detention charges incurring on day to day basis.

According to the petitioner, the  respondents through their illegal act of omission or commission are bent upon to harass the petitioner by assessing the said consignment of being “secondary quality” and to coerce him under apparent – designed for under enrichment because the rate of customs duty on the ” prime quality ” is lesser than that applicable to the ” secondary quality goods “.

Citing secretary Revenue division, Collector of Customs West as respondents, petitioner pleaded the SHC may kindly pass an order to allow the consignment from port area to bonded warehouse.
