Customs Appellate Tribunal rejects appeal filed by owner of smuggled HSD

LAHORE: Customs Appellate Tribunal has dismissed a case filed by Faiz Ullah Amin, a resident of Loralai, against additional collector of Customs (Adjudication) Faisalabad, additional director of Directorate of Intelligence and Investigation, Multan.

Member Technical Imran Tariq proceed the case and said in his final remarks that the appellant could not produce any proof regarding legal import of High Speed Diesel (HSD). There is no merit in the appeal and is not accepted.

Precise fact of the case that the senior intelligence officer of field intelligence unit, FIU, Dera Ghazi Khan received information that a truck containing smuggled HSD concealed in specially designed oil tanker. FIU team recovered foreign origin 23, 500 liters high speed diesel.

The appellant filed the case before the Customs Appellate Tribunal on the grounds that the Order in Original (OnO) passed by the additional collector of Customs (Appeals) not according to the law and passed in mechanical fashion and some others. On the other side the representatives of department appear before the court and denied allegations.

After hearing the case the Customs Appellate Tribunal dismissed the case with the remarks that the construction of tank is not according to the standard.
