SHC seek remarks from tax authorities on petition filed by textile mills

KARACHI: The Sindh High Court (SHC) has continued the interim order made earlier till the next date of hearing and directed the chief commissioner of the Large Taxpayers Unit (LTU) to submit para wise comments on a constitutional petition filed by Gadoon Textile Mills Limited and Fazal Textile Mills Limited against the impugned show cause notices issued by tax authorities.

A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain, was hearing the constitutional petition.

During the hearing counsel for the department requested to grant time to submit para wise comments. The court adjourned the hearing for September 19, 2016.

Earlier, counsel for the petitioners stated that petitioners are doing textile business according to law and fulfilling all the requirements and paying all liabilities regularly, however, collector of Customs Adjudication issued impugned show cause notices dated May 29,2015 and June 1,2015 for alleged evasion of taxes by mis-using SRO 1125(1/2001) dated December 31,2011 and amendment by way of SRO 154 ( 1 ) / 2013 dated February 28,2013.

Citing secretary Ministry of Finance, collector of Customs Adjudication – II, chief commissioner Large Taxpayers Unit (LTU) Karachi as respondents, petitioners pleaded the SHC may set aside impugned show cause notices and during the pendency of this petition the proceedings initiated by the respondents shall remain suspended, petitioners also pleaded the Court may restrain them from taking any coercive action against the petitioners.
