Release of chemical consignment: SHC dismisses appeal against tribunal’s order

KARACHI: The Sindh High Court has dismissed a special customs reference application (SCRA) filed by Chawala Dyed and Chemicals.

A divisional bench of SHC, comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi, dismissed the SCRA, which impugned the order of tribunal allowing provisional release of a chemicals consignment against payment of differential amounts of customs duty and other payables through post-dated cheques.

The applicant said that tribunal transgressed its authority by ordering provisional release on applicants’ application against post dated cheques.

The Special Customs Appellate Tribunal, Collector (Appeals), Collector Customs East are respondents in the case.

Customs’ lawyer Shakeel Ahmed advocate submitted that it was an old SCRA (2011) and applicant has lost interest in the proceedings. He maintained that the applicant itself filed the application before the tribunal for provisional release and also expressed readiness to pay differential amount, sales tax, income tax, other payables. He said that the tribunal’s order was legal, praying to the court to dismiss the SCRA.
