IHC to hear case filed by M/s Pakistan Telecom Mobile after Eid

ISLAMABAD: The Islamabad High Court (IHC) on Thursday adjourned the hearing of a tax reference filed by M/s Pakistan Telecom Mobile Limited, challenging recovery of outstanding tax amount of Rs 1,213,497.

Justice Aamer Farooq heard the case and adjourned the same following counsel’s plea seeking time to prepare arguments. The court would resume the hearing after Eid as the case was dated in the office and new date of hearing would be assigned by the court’s administration.

Pakistan Telecom Mobile Limited had asked the court to restrict the Large Taxpayers Unit, Islamabad (LTU) from recovering Rs 1,213,497 from it.

The department had issued the demand for the tax year 2014 in head of income tax under provisions of Income Tax Ordinance, 2001.

Federal Board of Revenue (FBR), officers of LTU including commissioner Inland Revenue, commissioner Inland Revenue (Appeals) and Appellate Tribunal Inland Revenue (ATIR) were made respondent in the case.

Pakistan Telecom Mobile Limited prayed that the assessment order issued by the LTU officer was illegal, unlawful and without legal grounds.

The appellant had submitted before the court that the impugned order was issued under malafide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard. It also stated that due legal course was not followed by the department in issuing the order.
