IHC directs parties to conclude arguments in ATIR case

ISLAMABAD: A division bench of the Islamabad High Court (IHC) on Tuesday directed parties to conclude arguments in a case filed against the Appellate Tribunal Inland Revenue (ATIR).

A division bench of the IHC comprising of Justice Shaukat Aziz Siddiqui and Justice Mohsin Akhtar Kayani heard the case and issued directives after hearing argument from both sides. This case was filed by M/s Aftab Traders in 2013 and since then different benches had heard the matter.

M/s Aftab Traders had challenged an ATIR decision before the court and had made ATIR the main respondent along with office bearers of Regional Tax Office (RTO), Islamabad. M/s Aftab Traders had, through the petition, challenged show cause notice pertaining to tax recovery claim in head of income tax.

The bench adjourned hearing of a case filed by Securities and Exchange Commission of Pakistan which had submitted a petition against officers of RTO, Islamabad. The commission had named Commissioner of Income Tax as main respondent.

Another bench of IHC comprising of Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb also adjourned hearing of three other tax references challenging decision announced by Customs Appellate Tribunal, Islamabad.

These references had been filed by M/s Shalimar Diplomatic Bonded Warehouse Islamabad. The company had submitted that Customs Appellate Tribunal had maintained department’s adjudication decision in ignorance of legal provisions. It had prayed to court to set aside decision announced by tribunal and de-seize the imported goods which had been seized by the department.

The court would resume hearing on the case as per the schedule issued by the IHC administration. The bench had dated in office the hearing of the case.
