SHC postpones hearing of appeal against M/s Gum Corporation

KARACHI: The Sindh high court (SHC) has postponed the hearing of an appeal filed by customs collector through the additional collector, challenging the Appellate Tribunal’s order over alleged mis-declaration/ attempted of tax evasion by M/s Gum Corporation (Private) Limited.

The wase was fixed for hearing before a two-member bench headed by Justice Aqeel Ahmed Abbasi. However, the court adjourned the hearing due to shortage of time for the date which would be announced by the SHC office.

Earlier, the counsel for the applicant stated that M/s Gum Corporation had imported a consignment of Glycerine & Triactin and filed two goods declarations for clearance of the goods $1.2525/kg and $1.1523/kg respectively, the value of the subject goods was determined under sub-section (9) of section 25 of the act $1, 55/kg (Glycerin) and $1.60/kg (Triacertin) respectively.

However, during the examination it was revealed that the importer committed gross mis-declaration on account of value of the goods whereas the actual value was determined under sub-section (9) of section (25) of the act. Show cause notice to the importer, however, importer filed appeal before the Appellate Tribunal which set aside the proceedings of the applicant.

M/s Citing Gum Corporation (Pvt) Ltd as respondent, applicant pleaded the SHC may declare that the Appellate Tribunal’s order is paternity illegal & definitely will encourage the unscrupulous importers for importing the goods with mis-declarations/ attempt of evasions of revenue.
