Customs moves SHC against tribunal’s verdict in mis-declaration case

KARACHI: The Model Customs Collectorate Appraisement-West has approached the Sindh High Court (SHC), challenging the impugned order of Customs Appellate Tribunal in a case of mis-declaration of consignment comprising “polyester knitted stretchable textile fabric” by M/s Batol Impex.

The petitioner stated that M/s Batol Impex imported the consignment which declared to contain “polyester knitted stretchable textile fabric” classifiable under PCT Heading 6005.3200 attracting 20 percent customs duty with declared value of $20,580 and filed goods declaration on August 10, 2016.

According to the applicant, the consignment was selected for scrutiny and during the examination of goods; the officials found polyester knitted ladies stretchable fabric and polyester furnishing fabric. On the basis of the examination report, it was revealed that undeclared items also found from the container, hence the charges of mis-declaration of description were imposed.

However, importer filed an appeal before the appellate tribunal which announced the proceedings of the applicant illegally, unjust and unlawfully.

Citing M/s Batol Impex as respondent, applicant pleaded the SHC may set aside impugned order of appellate tribunal and declared that applicant was found involved in mis-declaration.
