ISLAMABAD: The Islamabad High Court has granted stay on the appointment of a Federal Board of Revenue (FBR) officer, Muhammad Yasir Pirzada, as director general of Bureau of Immigration and Overseas Employment (BE&OE).
Justice Aamir Farooq, conducted hearing of the petition moved by Syed Rehmat Ali Shah challenging the appointment of Pirzada as BE&OC DG, directed the respondents to submit their replies till November 14.
In his petition, the petitioner made the cabinet division, Establishment Division, the Ministry of Overseas Pakistanis and Human Resource Development, FBR through its chairman and Muhammad Yasir Pirzada respondents.
Shah challenged a notification dated October 5, 2016, whereby the Establishment Division appointed a grade-19 officer of FBR’s Inland Revenue Service Yasir Pirzada against the post of grade-21 as BE&OE DG with the approval of the prime minister of Pakistan.
He alleged in the petition that Pirzada had less than 20-year experience in grade-17 and less than 15-year experience in grade-18, so his appointment in grade-21 was illegal. Moreover, the slot of BE&OE DG must be filled through promotion, by appointing one of the additional DGs of BE&OE. “In case, this post is filled by transfer, the officer must be in grade 21,” the petition said.
The petitioner contended the said post was regulated under the rules notified in the Gazette of Pakistan dated March 15, 2012. Under the said rules, a BPS-19 officer could not be given the charge of BPS-21.
He said Pirzada did not hold the requisite experience as the job description of BE & OE DG was entirely different from that of an inland revenue officer from the cadre of Occupational Group meant for the recovery and management of income tax.
