IHC adjourns hearing of tax references filed against Customs Appellate Tribunal, FBR till next week

ISLAMABAD: The Islamabad High Court (IHC) on Tuesday adjourned the hearing of a couple of tax references involving Customs Appellate Tribunal and the Federal Board of Revenue (FBR).

The IHC division bench comprising Justice Noor-Ul-Haq N Qureshi and Justice Athar Minallah heard the references filed by M/s Bestway Cement Limited and M/s MOL Pakistan Oil and Gas Company. The bench adjourned the hearing till next week.

M/s Bestway Cement Limited had filed the tax reference against Customs Appellate Tribunal. The appellant had challenged a decision announced by the tribunal before the IHC. M/s Bestway Cement Limited had also nominated officers of Regional Tax Office in the petition among respondent. M/s MOL Pakistan Oil and Gas Company had filed the tax reference against the Large Taxpayers Unit, Islamabad.

The appellant had submitted that the show cause notice issued to him under the head of federal excise duty (FED) was illegal and was based on mala-fide intentions.

Federal Board of Revenue (FBR), officers of LTU including commissioner Inland Revenue, and commissioner Inland Revenue (Appeals) were made respondent in the case.
