SHC restores NTN of Topsun Chemical Enterprises

KARACHI: The Sindh High Court (SHC) has restored national tax number (NTN) of M/s Topsun Chemical Enterprises for filing of fresh goods declarations against the consignments.

A two-member bench, comprising Justice Munib Akhtar and Justice Saeeduddin Nasir was hearing the petition filed by M/s Topsun Chemical Enterprises seeking de-blocking of its NTN and quash the FIR, which was lodged by customs authorities.

During the hearing, counsel for the petitioner sought time to file rejoinder; however, the counsel for the custom department requested the court for fixed a date. Therefore, the court fixed the date of hearing for November 15, 2016 and continued the interim order.

On last date of hearing, counsel for the petitioner had submitted before the court that it is not in position to filed good declaration against consignments due to blocking NTN by the customs and asked the court to restore the number. Therefore, the court had unblocked its NTN for filing of good declaration.

Earlier, counsel for the petitioner stated that petitioner is engaged in the business of import of pesticides and imported the consignment of thiophanate methyl WP 70 percent from China and filed goods declaration dated September 06, 2014 according with law.

The counsel further stated that FIR was lodged against the petitioner on the basis contention that the certificate of registration for import of said consignments as required under rule 9-A (1) of Agricultural Pesticides Ordinance 1971 is tempered/fake and blocked the NTN of the petitioner without following the due process of law, therefore, the petitioner is suffering huge financial losses.

Citing Appraisement-East and West collectors and Federal Board of Revenue (FBR) chairman as respondents, the petitioner pleaded the court may set aside impugned blocking sheet and direct the respondents to restore the NTN of the petitioner.
