SHC adjourns hearing of case filed by M/s Mega Enterprises till November 30

KARACHI: The Sindh High Court (SHC) directed the petitioner to filed a rejoinder on a constitutional petition filed by Mega Enterprises seeking release of a consignment of “embroidery ladies suits.

A two-member bench comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan was hearing the constitutional petition. During the hearing, counsel for the collector of Customs Preventive and assistant collector of custom R & D Air Freight Unit Karachi filed comments which were taken on record. The court adjourned the hearing for November 30, 2016.

Earlier, counsel for the petitioner stated that petitioner has imported a consignment of embroidery ladies suits 1250 pieces 104.1666 dozens and filed goods declarations dated 22/09/2016 and paid duty and taxes as per transactional value according with law.

According to the importer, however staff of the tax authorities without any reason hold the goods despite all the duty and taxes paid by the petitioner.

Citing secretary Revenue division, Collector of Custom Preventive and assistant collector of Custom R & D AFU Karachi as respondents, petitioner pleaded the court may direct that act of the respondents is illegal, mala fide and of no legal effect. Importer also pleaded the SHC may direct the respondents to release the consignment of the petitioner.
