The consignment was transshipped from Lahore to Dry Port Faisalabad. After arrival the said container, neither importer nor his authorized person approach for clearance of their consignment.

Taking guidance from the decision of the superior court and keeping in view facts of the case narrated, it is not ascertained whether the import of the goods was not a genuine one, it can be concluded that the goods was brought in to the country in a clandestine manner through an unauthorized route .

The examination team of Customs Faisalabad along with representative of FDPT during examination the bolt and rivets of the door of the container were apparently found tempered/altered.

It was also observed that the condition as well as packing of goods was quite shabby and not up to mark. It was suspect that pilferage of cargo has been taken place in the container en-route and high tariff good have been replaced with low tariff good. It is pertinent to mention here that an FIR has been lodged against accused company.

Sources said that Appraiser Muhammad Jameel Ahmed, Inspector Amjad Iqbal Cheema appeared in Adjudication department but no one appeared to defend the case from respondent’s side nor any written reply has been received from the respondent.

Therefore Additional Collector Customs Adjudication Beelamur Ramzan ordered to seize all goods under clause 14 of section 156(1) and section 157(1) and (2) of the Customs Act 1969.
