SHC seeks remarks from M/s Bismillah Industry on appeal filed by collector Port Qasim

KARACHI: The Sindh High Court (SHC) has directed the management of M/s Bismillah Industry and Member Judicial-II, Customs Appellate Tribunal Karachi to file their respective para-wise comments on an appeal filed by Collector Customs Collectorate Port Qasim, challenged impugned order of the Custom Appellant Tribunal in a case of evasion of duty and taxes of Rs 7, 321, 958.

A two-member bench comprising Justice Irfan Sadaat Khan and Justice Muhammad Humayun Khan was hearing the appeal.

Earlier, counsel for the applicant stated that respondent M/s Bismillah Industry imported a consignment which was declared to contain “zinc coated alloy steel sheets in coils of secondary quality” from Germany and filed goods declaration dated December 13, 2014.

According to the applicant, however, during the examination, imported goods were found as GP steel sheets secondary quality/ non alloy, therefore, it was revealed that the said importer is involved in evasion of short-levied duty and taxes amounting to Rs. 7, 321, 958, therefore, show cause notice was issued to the said importer. Being aggrieved said importer filed an appeal before the Customs Appellate Tribunal which was allowed and suspended the proceedings of customs department.

 

Citing M/s Bismillah Industry and the Member Judicial-II Customs Appellate Tribunal Karachi as respondents, applicant pleaded the court to suspend impugned order of the tribunal and restore the order of applicant.
