Customs Court grants bail to suspect allegedly involved in tax evasion case

KARACHI: Custom Taxation and Anti-Smuggling Court Judge Syed Faiz Rasool Rashdi granted bail to a suspect Shahid Khan who was arrested in a tax evasion case.

During the hearing, counsel for the suspect filed  the bail application and argued that the accused is innocent as he was sick and was not intentionally refusing to pay taxes. However, he submitted that the accused is undertakes to appear regularly before the court on every date of hearing. He lastly requested that bail may be granted to him. At this, the leaned special prosecutor for the state has opposed this bail application.

After both sides arguments, the court observed in its order that the accused/ applicant was granted bail on merit vide order dated 19/04/2012. The bail was cancelled due to his absence on several dates of hearing. Considering the arguments advance by the defence counsel, the accused is granted bail subject to furnishing fresh surety of Rs. 2, 00, 000 with price bound in the like amount to the satisfaction of this court.

According to prosecution, M/s Hanif Arif Nafie Ltd, Kabul, Afghanistan imported consignment said to contain toilet sop bars stuffed in container. The said containers were lifted under TDR by HMT contactor M/s Saif Cargo Services, M/s Geo Gul & M/s Abid Enterprises respectively. The said containers were gate out from port area on 18/01/2011 and no information about their cross border was received in MCC Appraisement till 11/02/2011, therefore, the NLC Authorities vide letter dated 12/02/2011 were requested to locate above referred containers and this FIR was lodged.

Accused Shahid Khan S/O Sher Akber was detained in crime no 11/2011 under section 156 (1) (63) (64) (82) (86) & (90) of the Customs Act, 1969 was registered by Model Customs Collectorate of Appraisement-West Custom House Karachi.
