DG Customs Valuation issues new valuation ruling of MDF board

ISLAMABAD: The Director General Directorate of Customs Valuation on the revision petition of MDF board importers  has issued a new valuation ruling regarding MDF board and  declare that the new rates will apply on the following Basis,(1) sheet thickness,2mm-3mm,weight of sheet 5 kgs, (2)T, 3mm-4mm,w-7 kgs, (3)T,5mm-6mm,w-12 kgs, (4)T,7mm-9mm,w-14 Kgs, (5)T, 10mm-14mm,w-20 kgs, (6)T-15mm-18mm, w-31 kgs, (7)T,19mm-21mm, w-42 kgs, (8)T,22mm-25mm,w-50 kgs, and as far as calculations are concerned the manufacturers and importers are agreed on the value.

The calculation shall be made by lowering values by $ 5/CBM in each category from the current valuation ruling. The value addition in value added products between raw MDF board and value added products (melamine etc.) should be 26% in all categories.

The difference between Sri Lanka and other origins may be kept intact on the basis of freight difference. This revision petition was filed by the Mushtaq Muhammad, Syed Raza Haider, Syed Bilal Ahmed, Bilal Jafrani, Abdul Rehman, Rafiq Jafrani, Javed Iqbal Butt and Jawed Mesiya, under section 25-D of the Customs Act 1969, against Customs value determined via valuation ruling no.873/2016 issued under 25-A of the Customs Act 1969. In valuation ruling no 873/2016 the weight taken is 4.3 kgs for 2.2mm 8 x 4ft which was not correct. Director General has said in order that weight of sheets from different origins, size and freight factor from different regions was ascertained for reviewing valuation ruling no 873/2016.

The basic issue was contested by the importers are that valuation ruling has been issued on the basis of wrong calculations. Different ranges have been made like 2-3mm, 3-6mm etc. In this range the value differ from 2mm to 3mm. In this category major import is of 2.2 mm and 2.3 mm sheets but the value has been fixed on the basis on weight of 2 mm and applied on whole range instead of taking average.

Similarly in 3-6 mm range calculations have been made on the basis of 3 mm sheet and applied on whole range. Moreover, the values have been fixed on the basis of $225/CBM (in one category) whereas the price in the international market ranges $ 190-$ 200.
