SHC issues notice to tax authorities on petition filed by D.M Traders

KARACHI: The Sindh High Court (SHC) issued notices to tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s D.M Traders challenging the valuation ruling no 863/2016 enhancing the value of Dove Soap from $ 1/kg to $ 1.90/kg.

While the hearing of constitutional petition, a two-member bench, headed by Jtice Munib Akhtar also directed them to file their respective comments on next date of hearing, court also adjourned the hearing for December 29, 2016.

Earlier, counsel for the petitioner stated that petitioner is engaged in the lawful import of Dove Soap from vario sources around the world including Germany, importer is aggrieved and serioly prejudiced by the illegal and mala fide action of the Director General of Valuation Directorate of Valuation Karachi whereby the said respondent has arbitrarly fixed the ctoms value of Dove Soap vide Valuation ruling no 863/ 2016 dated June 02, 2016 in the manner which is contrary to law and regulations and enhanced the ctom value from $ 1/kg to $ 1.90/kg.

Citing Sectary Revenue Division, the Collector of Ctoms Appraisement East Model Ctom Collectorate of Ctoms, the Director of Valuation Directorate of Valuation and the Director General of Valuation Directorate of Valuation Karachi as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

Importer also pleaded the court may set aside impugned valuation ruling and restrain them from taking any coercive action against the petitioner.
