Fraud case: FBR, PCA to face each other in Supreme Court

Islamabad: First time ever Federal Board of Revenue (FBR) and Directorate General Post Clearance Audit (PCA) will face each other in the Supreme Court

According to details, Directorate General Post Clearance Audit filed an appeal in the Supreme Court under the article 185-(3). The appeal was filed against the order dated August 2, 2016 passed by the Lahore High Court (LHC) single bench regarding the fiscal fraud of M/s JP Construction and Trading Company.

Directorate General Post Clearance Audit added the names of FBR Chairman, Chief Collector Lahore, Collector Appraisement Dry Port Mughalpura, Additional Collector of Customs Collectorate, CFS, NLC Thokar Niaz Baig, Deputy Collector Dry Port Mughalpura and Senior Manager NLC Thokar Niaz Baig in respondents.

The fraud of large amount of money and tax evasion billion of rupees by the paper construction companies is the basic reason of the conflict between two allies departments.

Sources told Customs Today that Directorate General Post Clearance Audit unearthed a fraud during audit investigation and the response of FBR and related customs offices was not supportive and contradictive to the law.

The construction companies involved in the above said fraud with collusion of alleged customs officials succeeded to get a relief order from LHC while the PCA was unaware of the proceedings of the case. It is pertinent to mention here that PCA seized the goods (Prime Movers) of M/s JP Construction Company. Now FBR will answer the allegations in the Supreme Court and it is quite possible that the case may refer to NAB for further investigation.
