ISLAMABAD: A single bench of the Islamabad High Court (IHC) has disposed of a case filed by M/s Orient Power Company (Private) Limited during previous week of February.
Justice Athar Minallah issued directions to the Large Taxpayers Unit to hear and decide the appellant’s departmental application within 30 days.
M/s Orient Power Company had filed a tax reference challenging a show cause notice issued by field office of Federal Board of Revenue (FBR) i.e. Large Taxpayers Unit, Islamabad.
The IHC bench also barred the department from taking any coercive measures for the recovery of disputed amount from the appellant.
ATIR, Federal Board of Revenue (FBR), officers of LTU including commissioner Inland Revenue, deputy commissioner Inland Revenue and commissioner Inland Revenue (Appeals) were made respondents in the case.
M/s Orient Power Company Private Limited also stated that show cause notice mentioning outstanding tax amount was issued with mala fide intentions. The appellant further prayed the court to bar the LTU from taking coercive measures against it.
The appellant had also prayed the court to decide the case early as the appellant had to bear financial complications after the case.
